Consumer terms and conditions of sale

These Terms apply to orders placed by individuals acting for purposes outside their trade, business, craft or profession.
Orders placed by architects, interior designers, retailers or other professional customers are governed by separate business terms.

The essential characteristics, dimensions, materials, finishes and conditions of use of each product are stated on its product page.
Each Flare is individually prepared, inspected and packed before dispatch.
Product photographs are intended to show the products as faithfully as possible. Slight differences in colour may result from screen settings, materials or finishing processes, without affecting the product’s essential characteristics.
Products are offered subject to availability.

The prices applicable are those displayed when the order is placed. They are shown in the currency available for the relevant market and include any taxes that Studio 12 Degrés is required to collect.
Delivery charges are shown separately before the order is confirmed.
For deliveries outside the European Union, import duties, local taxes or customs clearance charges may be collected from the recipient unless otherwise stated at checkout. These charges remain payable by the recipient.
Full payment is due when the order is placed. The accepted payment methods are those displayed at checkout.

Before confirming an order, the Customer can review the basket, total price, delivery address and information provided.
Confirming the order constitutes acceptance of these Terms and an obligation to pay the stated price.
An email confirming the order, amount paid and delivery timeframe is then sent to the Customer.
Studio 12 Degrés may refuse or cancel an order for a legitimate reason, including a declined payment, suspected fraud or product unavailability.
The version of these Terms applicable to an order is the version accepted when that order is placed.

Delivery takes place within 6 to 8 weeks from order confirmation. This period includes preparation and transportation.
The Customer must provide a complete and accurate delivery address.
Studio 12 Degrés remains responsible for the product until the Customer, or a third party designated by the Customer, takes physical possession of it.
If the announced deadline is exceeded, the Customer may request delivery within an additional reasonable period. If delivery still does not take place, the Customer may cancel the order in accordance with applicable law.
Customers are advised to inspect the parcel upon delivery and report any damage promptly. A failure to make reservations to the carrier does not remove the Customer’s statutory rights.

The Customer has fourteen days from receipt of the product to change their mind, without giving a reason.

The Customer should provide the order number and identify the product concerned. Studio 12 Degrés will acknowledge the request and send the return instructions by email.
The Customer may also use the “Withdraw from the contract” function available on the website or send any other clear statement expressing the decision to withdraw. No prior authorisation from Studio 12 Degrés is required.
The product must be sent back within fourteen days of the withdrawal request to:

The product must be returned complete, with all accessories, and adequately protected. The original packaging is recommended where it helps protect the piece, but its absence does not remove the right of withdrawal.
Direct return costs are borne by the Customer.
At the Customer’s request, Studio 12 Degrés may arrange collection or transportation. The cost will be communicated in advance and may be deducted from the refund with the Customer’s agreement.
Studio 12 Degrés will refund the price of the product and the standard outbound delivery charge within fourteen days of the withdrawal request.
The refund may be withheld until the returned product or evidence of its dispatch has been received. It will be issued using the original payment method.
Only a loss in value resulting from handling beyond what is necessary to examine the product may be deducted from the refund.

If a product arrives damaged, is defective or does not correspond to the order, the Customer should contact sales@douzedegres.fr, quoting the order number and describing the issue.
Photographs may help Studio 12 Degrés assess the request but are not a mandatory condition.
Where a product is defective or non-conforming, the costs required to collect, repair or replace it are borne by Studio 12 Degrés in accordance with applicable law.

Products benefit from the French statutory guarantee of conformity and the statutory warranty against hidden defects.

These statutory rights are free of charge and separate from the right of withdrawal.

Flare uses an open flame. It must be used with constant care and in strict accordance with the instructions and safety warnings supplied with the product.
Flare must be positioned or installed as instructed, on a stable and suitable surface. The stated safety distances and requirements concerning the surface behind the object must always be observed.
Flare must never be left unattended while lit, including when the user leaves the room or goes to sleep. It must be kept out of reach of children and animals, protected from draughts and kept away from curtains, textiles and other flammable materials.
Only candles meeting the dimensions and specifications stated in the instructions may be used. Flare must not be moved or handled while lit or still hot. It must be allowed to cool completely after the flame has been extinguished.
The user is responsible for following these instructions throughout the use of the product.

Studio 12 Degrés cannot be held liable for any fire, burn, property damage or personal injury where the damage results exclusively from:

• failure to follow the instructions or safety warnings;
• leaving the flame unattended;
• using an incompatible candle;
• incorrect installation or failure to observe the stated safety distances;
• placing the product close to textiles or other flammable materials;
• moving or handling the product while lit or still hot;
• modifying, misusing or using the product for an unintended purpose.

This provision does not limit Studio 12 Degrés’ liability where the damage results from a product defect, lack of conformity, inadequate safety instructions or any other breach for which Studio 12 Degrés remains legally responsible.

Personal data required to process payments, deliveries and orders is handled in accordance with the Privacy Policy available on the website.

Purchasing a product does not transfer any intellectual property rights relating to its design, the Douze Degrés trademark or the content of the website.

These Terms are governed by French law.
This choice does not deprive a consumer residing in another country of any mandatory and more protective rights granted by the law of their country of residence.
Jurisdiction will be determined in accordance with the applicable legal rules.
